1. DEFINITIONS
ENVIROTRADE EXPERT S.R.L. is the company that manages the WWW.BIOACTIVATORI.RO domain and its subdomains (hereinafter referred to as “SITE”).
ENVIROTRADE EXPERT S.R.L. is a commercial company with registered office in Cluj-Napoca, Cluj County, Str. Snagov nr 1 with tax registration code RO 4331075 , registered at the Cluj Trade Register Office under no. J12/3746/2020, phone: 0740156525
Throughout this document, the following capitalized terms shall, unless the context indicates otherwise, have the meanings specified below:
CONTINUOUS has the following definition:
- all information on the SITE that can be visited, viewed or otherwise accessed through the use of electronic equipment;
- the content of any e-mail sent to its USERS or CUSTOMERS by an ENVIROTRADE EXPERT/BIOACTIVATORI.RO employee/collaborator by electronic means and/or any other available means of communication;
- any information communicated by any means whatsoever by an ENVIROTRADE EXPERT/BIOACTIVATORI.RO employee to the USER or CUSTOMER, whether or not in accordance with the contact information specified by the USER or CUSTOMER;
- information related to products, services and/or prices charged by ENVIROTRADE EXPERT/BIOACTIVATORI.RO in a given period;
- information related to products, services and/or prices charged by a third party with which ENVIROTRADE EXPERT/BIOACTIVATORI.RO has concluded partnership contracts, in a given period;
- data relating to ENVIROTRADE EXPERT/BIOACTIVATORI.RO , or other privileged data of it.
PRODUCTS and SERVICES – any product or service, including the documents and services mentioned in the ORDER, to be provided by ENVIROTRADE EXPERT/BIOACTIVATORI.RO to the CLIENT as a result of the conclusion of the CONTRACT.
USER: is the natural or legal person who has or obtains access to the SITE CONTINUUM, by any means of communication made available by ENVIROTRADE EXPERT/BIOACTIVATORI.RO (electronic, telephone, etc.) or under a user agreement existing between ENVIROTRADE EXPERT/BIOACTIVATORI.RO and it and requiring the creation and use of an ACCOUNT.
CUSTOMER: natural or legal person or any legal entity that makes an ACCOUNT on the SITE and places an ORDER.
ORDER: is an electronic document, generated as a result of access to the SITE by a CUSTOMER, by which the CUSTOMER transmits ENVIROTRADE EXPERT/BIOACTIVATORI.RO its intention to purchase PRODUCTS and SERVICES from the SITE. Booking a PRODUCT by accessing the SITE is not an ORDER.
CONTRACT: is an ORDER confirmed by ENVIROTRADE EXPERT/BIOACTIVATORI.RO , whereby ENVIROTRADE EXPERT/BIOACTIVATORI.RO agrees to deliver PRODUCTS and SERVICES to the CUSTOMER, and CLINET agrees to make payment for them.
TRANSACTION – the collection or reimbursement of an amount resulting from the sale of a PRODUCT and/or SERVICE by ENVIROTRADE EXPERT/BIOACTIVATORI.RO to the CUSTOMER, using the services of the card processor approved by ENVIROTRADE EXPERT/BIOACTIVATORI.RO , regardless of the method of delivery.
NEWSLETTER – means of periodic information, exclusively electronic (e-mail, SMS), on the PRODUCTS/SERVICES and/or promotions carried out by ENVIROTRADE EXPERT/BIOACTIVATORI.RO in a given period, without any commitment on the part of ENVIROTRADE EXPERT/BIOACTIVATORI.RO with reference to the information contained therein.
MISUSE: is the use of the SITE in a manner contrary to industry practice, regulations and legislation in force or in any other manner that may cause damage to ENVIROTRADE EXPERT/BIOACTIVATORI.RO .
USERS/CLIENTS of this SITE are requested to read carefully the following terms and conditions of use.
2. ONLINE SALES POLICY
All the information used to describe the PRODUCTS and/or SERVICES available on the SITE (static/dynamic images/multimedia presentations/etc.) does not represent a contractual obligation on the part of ENVIROTRADE EXPERT/BIOACTIVATORI.RO, and is used exclusively for presentation purposes.
The promotions/offers on the WEBSITE are valid for a certain period of time and subject to stock availability.
Access to make an ORDER is allowed to any CUSTOMER/USER.
For justified reasons ENVIROTRADE EXPERT/BIOACTIVATORI.RO reserves the right to restrict the CLIENT/USER’s access to make an ORDER and/or to some of the accepted payment methods, if it considers that based on the conduct or activity of the CLIENT/USER on the SITE, his/her actions could in any way harm ENVIROTRADE EXPERT/BIOACTIVATORI.RO , In any of these cases, the CUSTOMER/USER may contact the Customer Support Department (clienti@bioactivatori.ro) of ENVIROTRADE EXPERT/BIOACTIVATORI.RO , to be informed of the reasons that led to the application of the above measures.
By placing an ORDER on the SITE, the CUSTOMER agrees to the form of communication (telephone or e-mail) by which ENVIROTRADE EXPERT/BIOACTIVATORI.RO conducts its operations on the SITE.
ENVIROTRADE EXPERT/BIOACTIVATORI.RO does not at any time consider an ORDER unconfirmed by ENVIROTRADE EXPERT/BIOACTIVATORI.RO as having the value of a CONTRACT.
The notification received by the CUSTOMER immediately after the ORDER has been placed is for information purposes and does not represent confirmation of the ORDER. This notification is made electronically (e-mail) or by telephone.
For justified reasons, ENVIROTRADE EXPERT/BIOACTIVATORI.RO reserves the right to modify the quantity of PRODUCTS and/or SERVICES in the ORDER. If we change the quantity of PRODUCTS and/or SERVICES in the ORDER, we will notify the CUSTOMER at the e-mail address or telephone number made available to ENVIROTRADE EXPERT/BIOACTIVATORI.RO when placing the ORDER and we will refund the amount paid.
The CONTRACT shall be deemed concluded between ENVIROTRADE EXPERT/BIOACTIVATORI.RO and the CLIENT upon receipt by the CLIENT from ENVIROTRADE EXPERT/BIOACTIVATORI.RO, via email and/or SMS, of the COMMENCEMENT confirmation notification. Therefore, the CONTRACT comes into force upon confirmation of the COMMENCEMENT by ENVIROTRADE EXPERT/BIOACTIVATORI.RO.
The Terms and Conditions of Use may be amended at any time by updating this SITE, such amendments becoming binding and effective immediately for all USERS/CLIENTS.
3. COMMENT
THE CUSTOMER/USER can place ORDERS on the WEBSITE, by adding the desired PRODUCTS and/or SERVICES to the shopping cart, and then complete the ORDER by making payment by one of the methods expressly indicated. Once added to your shopping cart, a PRODUCT and/or SERVICE is available for purchase to the extent that there is stock available for purchase. The addition of a PRODUCT/SERVICE to the shopping cart, in the absence of the completion of the ORDER, does not entail the registration of the ORDER, implicitly neither the automatic reservation of the PRODUCT/SERVICE.
By completing the ORDER, the CUSTOMER agrees that all data provided by him/her, necessary for the online purchase process, are correct, complete and true at the time of placing the ORDER.
By completing the COMMITMENT, CUSTOMER consents that ENVIROTRADE EXPERT/BIOACTIVATORI.RO may contact CUSTOMER, by any means available/agreeable to ENVIROTRADE EXPERT/BIOACTIVATORI.RO , in any situation where it is necessary to contact CUSTOMER.
ENVIROTRADE EXPERT/BIOACTIVATORI.RO may cancel the ORDER placed by the CUSTOMER, following prior notice to the CUSTOMER, without any further obligation of either party to the other or without either party being able to claim damages from the other in the following cases:
- non-acceptance of the Transaction by the bank issuing the CLIENT’s card, in case of online payment;
- invalidation of the Transaction by the card processor approved by ENVIROTRADE EXPERT/BIOACTIVATORI.RO , in case of online payment;
- the data provided by the CLIENT on the SITE are incomplete and/or incorrect.
4. PRICE OF PRODUCTS AND SERVICES
All prices for PRODUCTS and/or SERVICES presented on the WEBSITE are expressed in RON and include VAT.
In the case of online payments ENVIROTRADE EXPERT/BIOACTIVATORI.RO is/cannot be held responsible for any other additional costs incurred by the CLIENT, including but not limited to currency conversion fees applied by the bank issuing the card, if the currency of issue differs from RON. Responsibility for this action rests solely with the CLIENT.
Prices are subject to change by ENVIROTRADE EXPERT/BIOACTIVATORI.RO at any time without notice.
ENVIROTRADE EXPERT/BIOACTIVATORI.RO warns that there are cases when, as a result of malfunctions of the SITE or errors, the price displayed on the SITE may not be the real one. In these cases, ENVIROTRADE EXPERT/BIOACTIVATORI.RO will inform the CLIENT of the correct price.
5. MODE OF DELIVERY
The PRODUCT will be delivered to the CUSTOMER by door-to-door courier to the CUSTOMER or can be picked up from ENVIROTRADE EXPERT/BIOACTIVATORI.RO headquarters, according to the CUSTOMER’s option.
ENVIROTRADE EXPERT/BIOACTIVATORI.RO will ensure proper packaging of the PRODUCTS and will ensure the transmission of the accompanying documents.
ENVIROTRADE EXPERT/BIOACTIVATORI.RO will deliver the PRODUCTS and provide the SERVICES in Romania.
In case it cannot execute the CONTRACT because the PRODUCT is not available, ENVIROTRADE EXPERT/BIOACTIVATORI.RO will inform the CLIENT about this situation. ENVIROTRADE EXPERT/BIOACTIVATORI.RO may deliver to the CUSTOMER an alternative PRODUCT, in case the initially requested PRODUCT is not available, only after informing and with the consent of the CUSTOMER.
The details of delivery of the PRODUCTS/SERVICES including, but not limited to, the time required for delivery, shall not constitute a contractual obligation on the part of ENVIROTRADE EXPERT/BIOACTIVATORI.RO, without either party being entitled to claim damages from the other, in the event that either party may be or is in any way prejudiced by the breach thereof.
6. METHOD OF PAYMENT
The price, payment method and payment term are specified in each ORDER. The CUSTOMER is obliged to provide all the necessary information to issue the invoice according to the legislation in force.
For a correct communication of the invoice related to the ORDERS, the CUSTOMER is obliged to update whenever necessary the data in his ACCOUNT and to access the information and documents related to each ORDER, existing in the ACCOUNT.
If a PRODUCT and/or SERVICE ordered by the CLIENT cannot be delivered by ENVIROTRADE EXPERT/BIOACTIVATORS.RO, the latter will inform the CUSTOMER of this fact and will return to the CUSTOMER’s account the countervalue of the PRODUCT and/or SERVICE within a maximum of 7 (seven) days from the date ENVIROTRADE EXPERT/BIOACTIVATORI.RO became aware of this fact or from the date on which the CUSTOMER expressly expressed his intention to withdraw from the CONTRACT.
7. TRANSFER OF OWNERSHIP OF PRODUCTS
Unless otherwise agreed by ENVIROTRADE EXPERT/BIOACTIVATORI.RO and the CUSTOMER, ownership of the PRODUCTS will be transferred upon delivery, after payment by the CUSTOMER at the location indicated in the ORDER (meaning by delivery – signature of receipt of the transport document provided by the Courier or signature of receipt on the invoice in case of deliveries picked up personally by the CUSTOMER.
8. RIGHT OF WITHDRAWAL
According to the legislation in force, the CUSTOMER may exercise the right to withdraw from the CONTRACT within 14 (fourteen) days after taking possession of the PRODUCTS.
If the CLIENT requests withdrawal from the CONTRACT using Registration Form within the legal term, if the ORDER is paid, ENVIROTRADE EXPERT/BIOACTIVATORI.RO will refund the amount within a maximum of 14 (fourteen) days from the date ENVIROTRADE EXPERT/BIOACTIVATORI.RO informs the CLIENT of its decision to withdraw from the CONTRACT.
The amount will be returned as follows:
- for ORDERS paid by Bank Card -> by refund to the account from which the payment was made;
- for ORDERS paid by PO / Reimbursement / Bank Card-> by bank transfer to the account indicated by the CUSTOMER;
ENVIROTRADE EXPERT/BIOACTIVATORI.RO may postpone reimbursement until receipt of the PRODUCTS sold or until receipt of proof that they have been dispatched, if it has not offered to recover the PRODUCTS itself (the most recent date will be taken).
ENVIROTRADE EXPERT/BIOACTIVATORI.RO reserves the right to reduce the amounts reimbursed to the CLIENT by the amount resulting from the handling of the PRODUCTS, other than those necessary to determine the nature, characteristics and functionality of the PRODUCTS.
9. ADVERTISEMENT
ENVIROTRADE EXPERT/BIOACTIVATORI.RO NEWSLETTERs are sent through specialised partners approved by ENVIROTRADE EXPERT/BIOACTIVATORI.RO. This ensures confidentiality and security of information.
When the CUSTOMER creates an ACCOUNT on the WEBSITE, he/she has the possibility to express his/her consent to receive NEWSLETTER. The option regarding the agreement expressed by the CLIENT may be changed at any time.
The CUSTOMER or USER may unsubscribe from receiving the NEWSLETTER at any time by using the special link within any NEWSLETTER.
Opting out of receiving the NEWSLETTER does not imply opting out of this document.
10. LEGAL INFORMATION
ENVIROTRADE EXPERT/BIOACTIVATORI.RO shall not be liable for damages of any kind that the CUSTOMER or any third party may suffer as a result of ENVIROTRADE EXPERT/BIOACTIVATORI.RO’s performance of any of its obligations under the AGREEMENT and for damages resulting from the use of the PRODUCTS and SERVICES after delivery and in particular for loss thereof.
Warranties – All PRODUCTS benefit from warranty conditions in accordance with the legislation in force and the commercial policies of the manufacturers.
Complaints regarding defects of the purchased PRODUCT/PRODUCTS can be made by accessing the Contact Form.
Force Majeure – Neither party shall be liable for non-performance of its contractual obligations if such non-performance is due to an event of force majeure in accordance with applicable law.
Applicable Law/Jurisdiction – The CONTRACT is subject to Romanian law. Any disputes arising between ENVIROTRADE EXPERT/BIOACTIVATORI.RO and the CLIENT shall be settled amicably or, if this is not possible, the disputes shall be settled by the competent Romanian courts in Cluj- Napoca.
11. INTELLECTUAL PROPERTY RIGHTS
THE CONTENT, as defined in the preamble, including but not limited to logos, stylized representations, commercial symbols, static images, dynamic images, text and/or multimedia content presented on the SITE, are the exclusive property of ENVIROTRADE EXPERT/BIOACTIVATORI.RO, which reserves all rights obtained in this respect directly or indirectly (through licenses of use and/or publication).
CLIENT/USER is not permitted to copy, distribute, publish, transfer to third parties, modify and/or otherwise alter, use, link to, display, include any CONTENT in any context other than as originally intended by ENVIROTRADE EXPERT/BIOACTIVATORS.RO , inclusion of any CONTENT outside the SITE, removal of insignia signifying ENVIROTRADE EXPERT/BIOACTIVATORI.RO’s copyright in the CONTENT and participation in the transfer, sale, distribution of materials made by reproduction, modification or display of the CONTENT, except with the express written consent of ENVIROTRADE EXPERT/BIOACTIVATORI.RO .
Any CONTENT to which the CUSTOMER/USER has and/or obtains access by any means whatsoever is subject to this document, unless the CONTENT is accompanied by a specific and valid use agreement entered into between ENVIROTRADE EXPERT/BIOACTIVATORI.RO and the CUSTOMER/USER, and without any implied or express warranty made by ENVIROTRADE EXPERT/BIOACTIVATORI.RO with respect to that CONTENT.
CUSTOMER/USER may copy, transfer and/or use the CONTENT only for personal or non-commercial purposes, only if they do not conflict with the provisions of this document.
No Content transmitted to the CLIENT or USER, by any means of communication (electronic, telephonic, etc.) or acquired by the CLIENT or USER by accessing, viewing and/or browsing shall constitute a contractual obligation on the part of ENVIROTRADE EXPERT/BIOACTIVATORI.RO and/or the employee/employee of ENVIROTRADE EXPERT/BIOACTIVATORI.RO who arranged the transfer of the Content, if any, with respect to such Content.
Any use of the Content for purposes other than those expressly permitted by this Document or the accompanying User Agreement, if any, is prohibited.
